1. Introduction and Scope
These General Terms and Conditions ("Terms", "GTC") govern the access to and use of the digital platform operated by INTWIT Sàrl, a limited liability company duly registered under Swiss law, with its registered office in Geneva (hereinafter "INTWIT", "we", "us", or "our"), accessible at intwit.ch (hereinafter the "Platform").
By accessing, registering on, subscribing to, or using the Platform in any capacity, the user (hereinafter "User", "Subscriber", "you", or "your") expressly acknowledges having read, understood, and accepted these Terms in full. If you do not agree with these Terms, you must refrain from using the Platform.
These Terms apply exclusively to the production environment of the Platform (intwit.ch). Any pilot, beta, or development environment operated by INTWIT may be subject to separate terms communicated at the time of access.
2. Definitions
For the purposes of these Terms, the following definitions apply:
Platform: The website intwit.ch, including all subdomains, features, content, and services made available by INTWIT Sàrl in the production environment.
User / Subscriber: Any natural or legal person who has registered or subscribed to one of the Platform's plans to access its services.
Subscription Plan: The specific package of services made available to a Subscriber based on their category (Property Seeker, Individual Landlord, Real Estate Agency / Régie, Service Provider, etc.), as detailed on the Platform's Pricing page.
Free Registration Period: The initial sixty (60) day period of free access granted upon registration, as further described in Article 7.
Billing Cycle: The recurring six (6) month period during which a paid Subscription is active, as further described in Article 6.
Property Seeker / End-User: Any natural person registered on the Platform with the purpose of renting or purchasing real estate, and who is the primary intended beneficiary of the Your intwit Scout feature.
Individual Landlord: Any natural person, owner of one or more properties, registered on the Platform to publish property Listings in a private and
non-professional capacity, within the limit of three (3) properties maximum under this category.
Agency / Régie: Any real estate agency, brokerage, fiduciary, property administrator, or professional intermediary (in the Swiss sense of "Régie immobilière") registered under the dedicated professional plan, including individual Landlords whose portfolio exceeds three (3) properties and who are required to upgrade to this category.
Service Provider: Any professional, company, or agency, regardless of legal form, registered on the Platform to offer products or services related, directly or indirectly, to the real estate ecosystem. This includes, without limitation: architects, engineers, artisans, craftsmen, builders, renovation specialists, interior designers, insurance companies and brokers, moving and transportation companies, cleaning companies and agencies, security service providers, utility and telecom partners, property management professionals, surveyors, notaries, mortgage advisors, energy auditors, gardening and landscaping services, and any other professional service relevant to property owners, tenants, or buyers.
Listing: Any advertisement, property offer, or service offer published on the Platform by a Subscriber.
Content: All text, images, photographs, videos, data, descriptions, reviews, and any other material made available through the Platform.
Account: A personal, registered profile created by a Subscriber to access the services included in their Subscription Plan.
Paused Status: The state in which an Account remains accessible to its holder for data consultation purposes, but in which all features (publishing, visibility of Listings, contact, search, AI features, etc.) are deactivated due to non-confirmation or non-renewal of a paid Subscription.
Your intwit Scout: The proprietary AI-powered search and discovery feature developed by INTWIT Sàrl, powered by a Swiss Artificial Intelligence API, designed to assist Subscribers, primarily Property Seekers, in identifying real estate opportunities and relevant services outside the Platform, as further described in Article 12.

4. Purpose of the Platform
intwit.ch is a Swiss-made digital platform operating under a subscription-based model, designed to:
Allow subscribed Property Seekers to discover, browse, and compare real estate listings across Switzerland, and to benefit from the proprietary Your intwit Scout AI feature for extended search support.
Enable subscribed Individual Landlords (within the three-property limit) and Agencies / Régies to publish and manage property listings.
Connect subscribed Subscribers with verified Service Providers across a broad range of real estate-related sectors, including insurance, transportation, cleaning, construction, design, and other professional services.
Facilitate direct communication between Subscribers within the limits of their respective Subscription Plans.
Provide innovative, AI-assisted search and discovery tools developed by INTWIT, in particular Your intwit Scout, designed to enhance the user experience while strictly avoiding any unauthorised data scraping or extraction from third-party websites.
INTWIT Sàrl acts solely as a technical intermediary providing the digital infrastructure for connections between Subscribers. INTWIT is not a party to any contract, transaction, or agreement concluded between Subscribers through the Platform.

5. Access, Subscription Categories, and Registration
5.1 Subscription-Based Access
Access to the Platform's services is reserved for Subscribers. Browsing of certain public pages may be permitted without registration, but full functionalities (Listings, contacts, dashboards, advanced search, AI features, etc.) are accessible only to active Subscribers.

INTWIT offers differentiated Subscription Plans tailored to the specific needs of each category of Subscriber:

5.2.1 Property Seekers (End-Users)
Natural persons searching to rent or buy a property in Switzerland. This category benefits in priority from the Your intwit Scout AI feature, which provides extended search assistance both within and outside the Platform's internal Listings.

5.2.2 Individual Landlords
Natural persons, owners of one or several properties, acting in a private (non-professional) capacity. Individual Landlords may publish and actively manage up to three (3) properties maximum under this Subscription category.
Should an Individual Landlord wish to manage more than three (3) properties, or operate in a professional capacity, they are required to upgrade to the Agency / Régie Subscription Plan, which offers the appropriate features, capacity, and conditions corresponding to a professional real estate activity in the Swiss sense (Régie immobilière).
INTWIT reserves the right to detect non-compliance with this limit (e.g., through volume of activity, professional indicators, or multiple Account creation) and to require the Subscriber to upgrade their Subscription accordingly. Failure to upgrade may result in suspension or restriction of Listings exceeding the three-property limit.

Legal entities, partnerships, sole proprietors, or natural persons acting in a professional capacity in real estate brokerage, administration, or management. This Plan grants extended capacity for Listings, dedicated dashboards, multi-user management (where applicable), and professional features.

5.2.4 Service Providers
Any professional, company, or agency providing products or services related to the real estate ecosystem, in the broad sense defined in Article 2. This includes, without limitation, insurance companies and brokers, moving and transportation companies, cleaning companies and agencies, architects, artisans, designers, security providers, utility partners, and other professional services. Specific sub-categories or tiers may be defined on the Pricing & Subscription Plans page to reflect the diversity of professional activities.

Registration and subscription to the Platform are reserved for individuals aged 18 years or older with the legal capacity to enter into binding agreements, and for legal entities duly represented by an authorised person.

To register or subscribe, Users must create an Account and provide accurate, current, and complete information. Subscribers agree to:

Keep their login credentials confidential.
Use the Account strictly within the scope of their selected Subscription Plan and category.
Notify INTWIT without delay of any unauthorised use of their Account through the contact form.

Where the Subscriber's actual use of the Platform exceeds the limits or scope of their current Subscription Plan (in particular, the three-property limit for Individual Landlords, or a professional activity disguised as a private one), INTWIT reserves the right to require an upgrade to the appropriate category. Such upgrade may be billed pro rata or upon the next Billing Cycle, in accordance with the conditions communicated to the Subscriber.
Where the Subscriber's actual use of the Platform exceeds the limits or scope of their current Subscription Plan (in particular, the three-property limit for Individual Landlords, or a professional activity disguised as a private one), INTWIT reserves the right to require an upgrade to the appropriate category. Such upgrade may be billed pro rata or upon the next Billing Cycle, in accordance with the conditions communicated to the Subscriber.
5.6 Account Suspension or Termination
INTWIT reserves the right to suspend, restrict, or terminate any Account or Subscription at its sole discretion, in particular in cases of breach of these Terms, fraudulent activity, non-payment, circumvention of category limits, or misuse of the Platform.

6. Subscription, Billing, and Renewal
6.1 Subscription Plans and Pricing
The features, limitations, duration, and applicable fees of each Subscription Plan are detailed on the dedicated Pricing & Subscription Plans page of the Platform. By subscribing, the Subscriber expressly accepts the conditions of the selected Plan.

6.2 Currency and Taxes
All subscription fees are displayed in Swiss Francs (CHF). Until INTWIT Sàrl completes its VAT registration, subscription fees do not include VAT. Once INTWIT is registered for Swiss VAT, subscription fees will be subject to VAT at the applicable rate, and this Article shall be updated accordingly.

6.3 Billing Cycle
Subscription Plans are offered on a six (6) month Billing Cycle, payable in advance at the start of each cycle. The Billing Cycle begins on the date of activation of the paid Subscription, whether following the conclusion of the Free Registration Period or following a direct subscription.

6.4 Payment Methods
Payments are processed through secure third-party payment providers integrated into the Platform's payment gateway. The Subscriber authorises INTWIT (and/or its payment partners) to charge the chosen payment method for the corresponding subscription fees. By making a payment, Subscribers accept the terms and conditions of the relevant payment provider.

6.5 Renewal Notification and Automatic Renewal
INTWIT will notify each Subscriber at least fourteen (14) calendar days before the end of the current Billing Cycle, through the Platform and via in-Account notification, regarding the upcoming renewal.
Unless cancelled by the Subscriber before the end of the current Billing Cycle, Subscription Plans renew automatically for an additional six (6) month period, at the rate then in effect, and the corresponding fees will be charged to the registered payment method.
Subscribers may disable automatic renewal at any time through their Account settings.

The Subscriber may refuse the new conditions by cancelling the Subscription before the renewal takes effect.

6.7 Late or Failed Payment
In the event of failed or delayed payment, INTWIT reserves the right to place the Account into Paused Status (as defined in Article 2) until the outstanding amount is settled. Repeated non-payment may lead to termination of the Subscription and to collection procedures in accordance with Swiss law.

Except where required by mandatory provisions of Swiss law, subscription fees are non-refundable, including in cases of partial use, early cancellation, account suspension due to breach of these Terms, or upgrade from one category to another.

At the time of cancellation, or at any other moment, the Subscriber may submit a request for deletion of their personal data, in accordance with Article 14 and the Privacy Policy. Data deletion is subject to legal retention obligations described in Article 14.

7. Free Registration Period (60 Days)
7.1 Free Trial Offer
Upon registration, all new Subscribers, regardless of their category (Property Seeker, Individual Landlord, Agency / Régie, or Service Provider), benefit from a free registration period of sixty (60) consecutive days, starting on the date of Account activation.
7.2 Scope of the Free Period
During the Free Registration Period, Subscribers may access the features of the Platform corresponding to the standard offer of their selected category, as defined on the Pricing & Subscription Plans page. INTWIT reserves the right to define which features are included or excluded from the Free Registration Period, including any limitations on the use of Your intwit Scout during the trial.
7.3 End of the Free Registration Period and Conversion Mechanism
Prior to the expiry of the sixty (60) day Free Registration Period, INTWIT will notify the Subscriber, through the Platform and via in-Account notification, of the upcoming conversion of the trial into a paid Subscription.
Upon expiry of the Free Registration Period, the Subscriber will be automatically directed to the secure payment gateway of the Platform to confirm the activation of a paid six (6) month Subscription Plan corresponding to their category.
7.3.1 If the Subscriber Accepts the Conversion
The Subscriber proceeds through the payment gateway, validates the payment, and the paid six (6) month Billing Cycle begins immediately upon successful payment. The Subscriber continues to access all features of the chosen Subscription Plan, including Your intwit Scout where applicable, without interruption.
7.3.2 If the Subscriber Does Not Accept the Conversion
If the Subscriber does not complete the payment process at the end of the Free Registration Period, the Account is automatically placed into Paused Status. In this state:
All features are deactivated: no publishing, no visibility of Listings, no contact features, no advanced search, no AI features (Your intwit Scout), no dashboard functionalities.
All Listings become inactive and invisible to other Subscribers and visitors of the Platform.
The Subscriber retains access to their Account and to their own data strictly for consultation, modification, or export purposes, in line with applicable data protection rights.
The Subscriber may, at any time, exit Paused Status by activating a paid Subscription Plan through the payment gateway, in which case all features and Listings are reactivated.
7.4 Non-Renewable Nature
The Free Registration Period is granted once per Subscriber and per registered legal or natural person. It is not renewable, transferable, or convertible into cash, credit, or any other compensation.
7.5 Anti-Abuse
INTWIT reserves the right to detect, suspend, or terminate any Account suspected of being created with the purpose of circumventing the limits of the Free Registration Period (e.g., duplicate Accounts, false identities).
7.6 Data Retention During Paused Status
Accounts in Paused Status are retained in accordance with the data protection principles set out in Article 14, the Privacy Policy, and applicable legal retention obligations.
8. Promotional Offers
INTWIT may, from time to time, offer additional discounts, promotional Subscriptions, or extended trial periods under specific conditions communicated at the time of the offer. Such promotional offers are independent of the standard sixty (60) day Free Registration Period and are subject to their own terms.
9. Subscriber Obligations and Conduct
Subscribers undertake to use the Platform lawfully, ethically, and in accordance with these Terms and the scope of their Subscription Plan. In particular, Subscribers agree not to:
Publish false, misleading, defamatory, discriminatory, or unlawful Content.
Infringe upon intellectual property rights of third parties.
Share their Account credentials or transfer their Subscription without authorisation.
Use the Platform for spam, unsolicited commercial communications, or fraudulent purposes.
Circumvent the limits or features of their Subscription Plan, including the three-property limit applicable to Individual Landlords, or the conditions of the Free Registration Period.
Create multiple Accounts to abuse the Free Registration Period or to bypass category limits.
Circumvent, disable, or interfere with security or technical features of the Platform.
Use automated tools (bots, scrapers, crawlers) to extract data from the Platform or from Your intwit Scout results without prior written authorisation.
Misuse, reverse-engineer, or attempt to replicate the Your intwit Scout AI feature.
Misrepresent their identity or affiliation with any person or entity.
Publish Content containing viruses, malware, or harmful code.
Use the Platform to harass, intimidate, or harm other Subscribers.
Any violation may result in immediate suspension or termination of the Account and Subscription, without refund, and where applicable, in legal action.
10. Listings and Content Published by Subscribers
10.1 Subscriber Responsibility
Subscribers who publish Listings or Content are solely responsible for the accuracy, legality, and completeness of the information provided. They warrant that they have all necessary rights and authorisations to publish such Content.
10.2 Listing Limits
The number, duration, visibility, and features of Listings depend on the Subscription Plan held by the Subscriber, as described on the Pricing & Subscription Plans page. In particular:
Individual Landlords may publish and manage a maximum of three (3) property Listings simultaneously.
Agencies / Régies are not subject to the three-property limit and benefit from extended Listing capacity in line with the conditions of their Plan.
Service Providers may publish service Listings within the scope and limits defined for their professional sub-category.
10.3 Status of Listings During Paused Status
Where an Account is placed into Paused Status (e.g., end of Free Registration Period without conversion, non-payment, exceeded category limits, or other circumstances defined in these Terms), Listings become inactive and invisible to other Subscribers and visitors. Listings will be automatically reactivated upon successful activation of a paid Subscription Plan, subject to compliance with the conditions of the applicable category.
10.4 Content License
By publishing Content on the Platform, Subscribers grant INTWIT a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, and distribute such Content for the purposes of operating, promoting, and improving the Platform.
10.5 Moderation
INTWIT reserves the right, but has no obligation, to review, moderate, modify, or remove any Content that violates these Terms or applicable law, without prior notice and without refund of subscription fees.
11. Service Providers
11.1 Scope
The Service Provider category is open to any professional, company, or agency offering products or services related, directly or indirectly, to the real estate ecosystem. This includes, without limitation:
Insurance companies, brokers, and intermediaries (home insurance, civil liability, tenant insurance, etc.).
Transportation and moving companies and agencies.
Cleaning companies and agencies (residential, commercial, end-of-lease, etc.).
Architects, engineers, surveyors, energy auditors.
Artisans, craftsmen, contractors, builders, renovation specialists.
Interior designers, decorators, landscapers.
Security service providers, locksmiths, alarm and surveillance providers.
Utility, telecom, and energy partners.
Mortgage advisors, financial advisors, notaries (within the limits of their professional regulations).
Property management specialists, technical maintenance providers.
Any other professional service relevant to property owners, tenants, or buyers.
11.2 Verification
INTWIT may apply a verification process for Service Providers (identity, professional credentials, business registration, references, applicable licenses, insurance certificates where relevant). However, INTWIT does not guarantee the quality, suitability, legality, or outcome of any services provided by Service Providers.
11.3 Professional Compliance
Service Providers warrant that they comply with all laws, regulations, licensing, and professional standards applicable to their activity in Switzerland (and any other relevant jurisdiction). This includes, where applicable, holding valid professional insurance, business permits, FINMA authorizations (for insurance brokers), transportation licenses, and any other regulatory requirement.
11.4 Independent Status
Service Providers operate as independent professionals or entities. There is no employment, agency, partnership, or joint venture relationship between INTWIT and Service Providers.
11.5 Contracts Between Subscribers
Any agreement, transaction, or service contract concluded between a Subscriber and a Service Provider (or Individual Landlord, or Agency / Régie) is a direct contract between those parties. INTWIT is not a party to such contracts and bears no liability for their execution, performance, quality, delivery, or outcome.
12. Your intwit Scout — Proprietary AI Feature
12.1 Description
Your intwit Scout is a proprietary, innovative AI-powered search and discovery feature, developed and owned by INTWIT Sàrl, integrated into the Platform. It is designed to assist Subscribers, and primarily Property Seekers / End-Users (tenants and buyers), in identifying real estate opportunities and relevant services that may exist outside the Platform's internal Listings, particularly during the initial stage when the Platform's internal database of properties is still being built up.
Your intwit Scout may also be progressively made available to other categories of Subscribers (Individual Landlords, Agencies / Régies, Service Providers) with category-specific functionalities, as detailed on the Platform.
12.2 Underlying Technology and Swiss AI API
Your intwit Scout is powered by a Swiss-based Artificial Intelligence API, selected by INTWIT to ensure a high standard of data protection, sovereignty, and compliance with the nFADP and the GDPR. INTWIT has designed this feature specifically to avoid any scraping, harvesting, or unauthorised extraction of data from third-party websites or external real estate portals. Search results are generated through the AI provider's lawful information retrieval capabilities and do not result from direct, automated extraction of third-party listings by INTWIT.
12.3 Functional Scope
Depending on the Subscriber's category and Subscription Plan, Your intwit Scout may, in particular:
Suggest properties, neighbourhoods, or districts matching the Subscriber's stated criteria (location, budget, surface, type of property, lifestyle, etc.).
Provide contextual information (transport, amenities, schools, market trends, general indications regarding rental or purchase prices).
Identify potentially relevant Service Providers for a given need (insurance, transportation, cleaning, renovation, etc.).
Offer guided assistance throughout the search, comparison, or pre-decision phase.
12.4 Nature of the Results and No Guarantee
Subscribers acknowledge and accept that the outputs of Your intwit Scout are AI-generated suggestions and indications, provided "as is" and for informational purposes only. In particular:
Results may be incomplete, inaccurate, outdated, or subject to AI errors or hallucinations, including but not limited to invented references, mis-attributed information, or imprecise estimates.
Results do not constitute professional, legal, financial, real estate, insurance, or tax advice, nor a binding commercial offer.
The availability, status, price, or characteristics of any external property or service identified by Your intwit Scout must be independently verified directly by the Subscriber with the relevant source, owner, agency, or service provider.
INTWIT is not the originator, owner, or seller of external properties or services that may be referenced by Your intwit Scout and bears no responsibility for their existence, legality, availability, or accuracy.
12.5 Subscriber Responsibility When Using Your intwit Scout
Subscribers undertake to use Your intwit Scout reasonably and lawfully, and in particular:
Not to enter into Your intwit Scout any unlawful, defamatory, discriminatory, or infringing content.
Not to enter any personal data of third parties without legitimate basis.
Not to use Your intwit Scout for purposes incompatible with these Terms (e.g., systematic data mining, building competing services, training competing AI models).
Not to attempt to bypass, reverse-engineer, or replicate the feature.
Not to rely solely on AI outputs for material decisions (rental, purchase, insurance contract, hiring a service provider) without independent verification.
12.6 Data Processing Within Your intwit Scout
The queries entered into Your intwit Scout, and any related interaction data, are processed by INTWIT and by its Swiss AI API provider, acting as a processor on behalf of INTWIT, for the following purposes:
Delivering the requested AI-based search results.
Improving the relevance, accuracy, and user experience of the feature.
Ensuring security, fraud prevention, and abuse detection.
Such processing is carried out in compliance with the nFADP, the GDPR (where applicable), and the principles set out in Article 14 below. Additional details are provided in the Privacy Policy.
12.7 Intellectual Property
Your intwit Scout, including its name, design, prompts, workflow, integration logic, and user interface, is an innovative feature invented and owned by INTWIT Sàrl (subject to third-party rights of the underlying Swiss AI API provider on the API itself). The feature is protected by Swiss and international intellectual property laws. Any unauthorised reproduction, reverse engineering, replication, or commercial use is strictly prohibited.
12.8 Availability and Evolution
INTWIT reserves the right to modify, suspend, enhance, or discontinue Your intwit Scout or any of its sub-features at any time, in particular for technical, legal, security, or commercial reasons. No subscription fee paid by a Subscriber shall give rise to a refund as a consequence of changes affecting Your intwit Scout, except where mandatory law requires otherwise.
13. Intellectual Property
All elements of the Platform, including but not limited to the logo, brand name "INTWIT", brand name "Your intwit Scout", source code, design, graphics, databases, texts, AI prompts and workflows, integration logic, and software, are the exclusive property of INTWIT Sàrl or its licensors and are protected by Swiss and international intellectual property laws.
Any reproduction, distribution, modification, reverse engineering, or commercial use without prior written authorisation is strictly prohibited and may result in civil and criminal sanctions.
14. Data Protection, Privacy, and Retention
14.1 Applicable Legal Framework
INTWIT Sàrl is committed to protecting the personal data of its Subscribers in full compliance with:
The revised Swiss Federal Act on Data Protection (nFADP), in force since 1 September 2023, and its Ordinance (FADPO).
The EU General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679), where applicable to Subscribers located in the European Union or European Economic Area.
14.2 Data Controller
INTWIT Sàrl, with its registered office at Rue du Rhône 80, c/o ExpertFid & Audit SA, 1204 Geneva, Switzerland, acts as data controller for the personal data processed in the context of the Platform, including data processed via Your intwit Scout.
14.3 Purposes of Processing
Personal data is collected and processed solely for the following purposes:
Account creation, verification, and management (identity verification, eligibility checks, authentication, category compliance verification, such as the three-property limit applicable to Individual Landlords).
Provision and operation of the subscribed services, including Listings, search, communication between Subscribers, and the Your intwit Scout AI feature.
Billing, payment processing, and accounting obligations.
Communication regarding the Subscription, the Platform, and these Terms (renewal notices, security alerts, service updates).
Compliance with legal and regulatory obligations under Swiss law.
Security, fraud prevention, and integrity of the Platform.
Improvement of the Platform and its AI features, where based on legitimate interest or consent, and within the limits set out in the Privacy Policy.
INTWIT processes personal data only to the extent necessary for the above-listed purposes, in accordance with the principles of lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, storage limitation, integrity, and confidentiality.
14.4 Legal Basis for Processing
Depending on the type of processing, INTWIT relies on the following legal bases:
Performance of the contract (provision of the subscribed services, including AI features).
Compliance with legal obligations (accounting, tax, AML, etc.).
Legitimate interests (security, fraud prevention, service improvement), provided they do not override the Subscriber's fundamental rights and freedoms.
Consent, where required (e.g., certain cookies, marketing communications, optional AI personalisation features).
14.5 Processing in the Context of Your intwit Scout
INTWIT engages a Swiss-based AI API provider as a processor for the operation of Your intwit Scout. This provider acts on behalf of INTWIT, under a written data processing agreement compliant with the nFADP and the GDPR. INTWIT ensures that:
Data is processed within Switzerland or, where applicable, in jurisdictions offering an adequate level of protection.
Appropriate safeguards (encryption, access control, contractual clauses) are in place.
No personal data is used to train AI models for purposes unrelated to the Platform without the Subscriber's explicit consent.
No data scraping or unauthorised extraction of third-party content is performed by INTWIT in the context of Your intwit Scout.
14.6 Data Retention
14.6.1 Financial and Accounting Data
In accordance with Article 958f of the Swiss Code of Obligations and the Swiss Federal Act on Direct Federal Taxation, business records, invoices, accounting documents, and related financial data are retained for a period of ten (10) years from the end of the relevant fiscal year.
14.6.2 Personal Data Related to the Account, Subscription, and AI Interactions
Personal data not subject to the legal retention obligation set out in Section 14.6.1 is retained only for the duration strictly necessary for the purposes of processing and verification, and in particular:
During the active life of the Account and the related Subscription, including periods of Paused Status.
For a limited period after deletion or closure of the Account, defined in the Privacy Policy, to handle legal claims, disputes, and verification requests.
Your intwit Scout interaction data (queries, logs) is retained for the minimal duration necessary for service operation, security, and quality improvement, as detailed in the Privacy Policy.
14.6.3 Deletion Upon Request
Upon request by the Subscriber (Article 6.9.4), personal data not subject to the legal retention obligation will be deleted or anonymised within a reasonable period following the request, in accordance with the procedures described in the Privacy Policy.
14.7 Subscriber Rights
Subscribers have the following rights regarding their personal data, as guaranteed by the nFADP and, where applicable, the GDPR:
Right of access to their personal data.
Right to rectification of inaccurate or incomplete data.
Right to erasure ("right to be forgotten"), subject to applicable legal retention obligations.
Right to restriction of processing.
Right to object to certain types of processing.
Right to data portability.
Right to withdraw consent, where processing is based on consent.
Right not to be subject to a decision based solely on automated processing (including AI-based features) that produces legal effects or similarly significant effects, where applicable.
Right to lodge a complaint with the competent supervisory authority (in Switzerland, the Federal Data Protection and Information Commissioner (FDPIC); in the EU, the relevant national data protection authority).
Such requests may be submitted via the contact form available on the Platform.
14.8 Data Security
INTWIT implements appropriate technical and organisational measures to ensure a level of security adequate to the risks associated with the processing of personal data, including encryption, access controls, secure hosting (preferably in Switzerland), regular security audits, and contractual safeguards with sub-processors.
14.9 Data Transfers
Where personal data is transferred outside of Switzerland or the European Economic Area, INTWIT ensures that such transfers comply with the safeguards required by the nFADP and the GDPR (adequacy decisions, standard contractual clauses, etc.).
14.10 Privacy Policy
Further details on the collection, processing, storage, and rights of Subscribers concerning their personal data, including in the context of Your intwit Scout, are set out in the Privacy Policy – Data Protection Statement, which forms an integral part of these Terms.
15. Cookies and Tracking Technologies
The Platform uses cookie-less and similar technologies to enhance the user experience, analyse traffic, and personalise Content. Details on the types of cookies used and Subscriber choices are available in the Privacy Policy – Data Protection Statement.
16. Disclaimer and Limitation of Liability
16.1 Platform Provided "As Is"
The Platform, including the Your intwit Scout AI feature, is provided on an "as is" and "as available" basis. INTWIT makes no warranty, express or implied, regarding the uninterrupted availability, accuracy, completeness, or reliability of the Platform, its Content, or its AI outputs.
16.2 No Warranty on Listings or AI Outputs
INTWIT does not guarantee the accuracy, legality, or quality of Listings, properties, or services published by Subscribers, nor the accuracy or completeness of suggestions provided by Your intwit Scout. Subscribers are responsible for conducting their own due diligence before entering into any agreement, signing any contract, or making any material decision.
16.3 Limitation of Liability
To the fullest extent permitted by Swiss law, INTWIT Sàrl shall not be liable for:
Indirect, incidental, consequential, or punitive damages.
Loss of profits, data, opportunities, or reputation.
Damages resulting from interactions between Subscribers.
Damages caused by interruptions, errors, or security breaches beyond INTWIT's reasonable control.
Damages arising from AI errors, hallucinations, or misleading outputs of Your intwit Scout.
INTWIT's total aggregate liability, in any case, shall not exceed the total amount of subscription fees paid by the Subscriber to INTWIT during the six months preceding the event giving rise to the claim.
16.4 Force Majeure
INTWIT shall not be held liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, cyberattacks, government actions, AI provider outages, or third-party service provider outages.
17. Production Environment Only
These Terms apply exclusively to the production environment accessible at intwit.ch.
Any pilot, staging, beta, or development environment operated by INTWIT is not subject to these Terms. Access to such environments, if granted, may be subject to separate testing terms or evaluation agreements communicated by INTWIT at the time of access.
18. Links to Third-Party Websites
The Platform, and where applicable Your intwit Scout, may contain or surface links to external websites or third-party services. INTWIT does not control and assumes no responsibility for the content, privacy practices, or operations of such third-party websites.
19. Modifications to the Terms
INTWIT reserves the right to modify these Terms at any time. Subscribers will be notified of material changes through the Platform or via notification within their Account, at least thirty (30) days before the changes take effect. Continued use of the Platform after such modifications constitutes acceptance of the revised Terms. Subscribers who do not accept the changes may terminate their Subscription before the changes take effect.
20. Termination
20.1 Termination by the Subscriber
Subscribers may terminate their Subscription at any time, in accordance with Article 6.9, with effect at the end of the current six (6) month Billing Cycle. Listings and Content remain active until the end of the Billing Cycle. Subscribers may also request deletion of their personal data subject to legal retention obligations described in Article 14.
20.2 Termination by INTWIT
INTWIT may terminate or suspend access to the Platform at its sole discretion, particularly in case of breach of these Terms, non-payment, circumvention of category limits (such as the three-property cap for Individual Landlords), or misuse of Your intwit Scout. Upon termination, certain provisions (intellectual property, liability, data retention, governing law) shall survive.
21. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with Swiss law, to the exclusion of conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Canton of Geneva, Switzerland, subject to mandatory provisions of Swiss law in favour of consumers.
22. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
23. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, the Pricing & Subscription Plans page, and any specific terms applicable to particular categories of Subscribers (Property Seekers, Individual Landlords, Agencies / Régies, Service Providers) and to Your intwit Scout, constitute the entire agreement between the Subscriber and INTWIT Sàrl regarding the use of the Platform.
